The 8th U.S. Circuit Court of Appeals has upheld a lower court’s decision denying unitary (desegregated) status to the Little Rock School District. So the lawyering will continue in a case with roots 50 years old. The School Board will meet at 5 p.m. today to discuss the latest ruling.
The district’s shortcoming is in assessing the value of programs aimed at closing the achievement gap between white and black students. The appeals court took pains to note that the district isn’t in constitutional violation. Rather, it has failed to comply with some technical aspects of an agreement on settling the case.
