A federal district judge in Massachusetts has ruled that the federal Defense of Marriage Act is unconstitutional. The ruling was both on how it infringed on rights in Massachusetts, where same-sex marriage is legal, and on an equal protection arguments similar to those raised in a pending challenge in California against a state gay marriage ban.
