The state Supreme Court today outlined the questions it will answer, as suggested by a federal court, on what state law requires as the federal court considers a lawsuit seeking to block construction of SWEPCO’s coal-fired power plant in Hempstead County. Since state courts have invalidated Public Service Commission approval of the plant, SWEPCO has moved to build the unit as a “merchant plant,” selling power on the wholesale market rather than to retail customers in Arkansas. A key question is whether it can remove itself from state jurisdiction having originally sought state approval.
