The Arkansas Supreme Court has set a date to hear arguments in the appeal of a lower court ruling that struck down Initiated Act 1 as unconstitutional. Oral arguments are scheduled for March 17.

The act, which was approved by 57 percent of voters in November 2008, was ruled unconstitutional by Pulaski County Circuit Judge Chris Piazza in April 2010. It declared that foster children couldn’t be placed in the homes of unmarried couples. It ostensibly bans both unmarried heterosexual and homosexual couples from being foster parents, but the ban was clearly aimed at preventing gays from foster parenting.
