The 8th U.S. Circuit Court of Appeals today issued a one-sentence order denying an emergency stay of federal District Judge Brian Miller’s order ending state desegregation aid to the three Pulaski County public school districts. It said:
Appellant’s motion for stay is denied as prematurely filed.
Chris Heller, attorney for the Little Rock School District, said in an e-mail to School Board members:
Attached is the 8th Circuit Order issued about twenty minutes ago. The Order means that the 8th Circuit will give the District Court the first opportunity to decide our Motion for Stay before the 8th Circuit will take up the issue. The responses to our Stay Motion in the District Court are due early next week. We expect the Joshua Intervenors, PCSSD and NLRSD to file responses in support of our Stay Motion by that deadline. We also expect that the District Court will decide the Motion expeditiously once all responses are filed. Please call if you have any questions.
