The U.S. Supreme Court begins announcing decisions with a Texas fair housing case in which Justice Anthony Kennedy formed the 5-4 majority against the conservative justices. More to come this morning.

UPDATE: The housing case is a pretty big deal. It says that housing discrimination need not be intentional to be illegal if it creates disparate impact on, say, black tenants.

Statistics can be used to gauge impact — such as limiting housing vouchers to minority neighborhoods or in lending practices. Complaints about disparate impact of practices surface periodically in Arkansas, such as in screening prospective tenants.
