Republican Rep. Julie Mayberry of East End, her husband, former Rep. Andy Mayberry, and a daycare operator have sued to stop the issuance of a liquor store permit on Arch Street Pike in East End.

They contend procedural flaws in the application and argue that the liquor store couldn’t be adequately policed and is opposed by local residents. They also claim daycare centers should be considered schools and two daycare centers put the store in violation of rules about proximity to schools.

The lawsuit says two daycares qualify as schools because they are licensed by the state has having educational components. ABC staff found that the application by Dr. Harry Bryant did not run afoul of the rule requiring 1,000 feet separation from schools. The plaintiffs contend that an opinion from Attorney General Leslie Rutledge supports their contention that
