We’ve just received word that U.S. District Judge Price Marshall has denied a request for a student transfer from the Jacksonville/North Pulaski School District to the school district in neighboring Cabot.

The transfer request was previously approved by the state Board of Education in July over the objections of JNPSD and despite the fact that the newly created district is a party in the decades-old Pulaski County desegregation case.

The Arkansas school choice law allows a district an exemption from allowing student transfers if the district is under a federal desegregation order. When JNPSD was detached from the Pulaski County Special School District, it agreed to not participate in school choice. Despite objections from the Jacksonville district, the state board still authorized the transfer.

Now, Judge Marshall has pushed back against the state board. He indicated at the hearing today that it has no jurisdiction over the matter.
