A federal judge in Philadelphia has ruled that the federal government had acted unconstitutionally in withholding federal money from Philadelphia, which has said it won’t turn over immigrants to immigration authorities except on signed court order.

The government decision to withhold $1.6 million was arbitrary and capricious, the judge said. Also this:

In his opinion, Baylson cited public remarks made by Sessions and President Donald Trump accusing immigrants of committing more crimes than native-born citizens. Those statements “are inaccurate as applied to Philadelphia, and do not justify the imposition of these three conditions” in order to receive the grant money, the judge wrote in his opinion.

Chicago prevailed in a similar federal court challenge.
