News from John Moritz of the Arkansas Democrat-Gazette at today’s Arkansas Bar Association convention:
Every member of the Arkansas Supreme Court should say the same because Issue 1 strips the Supreme Court of power over rules of court procedure and turns it over to the legislature. That means turning rule-making over to the special interests that control the legislature, sometimes by corrupt means.
Every member won’t say the same. Shawn Womack, a fervent supporter of blocking the courthouse to damage suits, which Issue 1 would do, said yesterday on Twitter that he had no public opinion on the issue. Bull. He’s for it. It makes an already easy job for a hyperpolitical justice primarily interested in pay and perks even easier.
If you believe in the checks and balance of a three-branch government, you should oppose Issue 1. If you want Womack’s pals at the nursing homes and chambers of commerce to run the courts, then Issue 1 is for you. It makes the value of an elderly person abused in a nursing home or a child killed by malpractice almost worthless. But it does enrich the corporate outlaws.
