REVERSED: Judge upends approval of planned development in western Little Rock.

Circuit Judge Wendell Griffen
today reversed the Little Rock Planning Commission’s approval of a proposed residential development known as Mergeron Court.

The Wingate Neighborhood Association and others sued over the approval of a 12-home preliminary plat for two acres between Wingate and Kaylin Hills near the 8000 block of West Markham across from Brady Elementary.

The judge said the proposal hadn’t included an engineering analysis required for flood-prone land. He said there was a potential for harm if the project was done without the engineering.

He held the Planning Commission action to be arbitrary, reversed it and sent the case back to the commission.

Here’s the judge’s opinion.
