Interesting story on NEA Report about the arrest last week of a West Memphis man for possession of 1.5 grams of marijuana. He has a card allowing him to purchase medical marijuana. Police weren’t dissuaded.

Does it matter if the marijuana in his possession was purchased from a licensed dispensary or not? (The article isn’t clear on whether it was or not.)

The article says the Arkansas medical marijuana law protects people from arrest for possession unless they have more than 2.5 ounces. And the law doesn’t say marijuana must be in dispensary packaging. Dispensaries must sell marijuana in childproof packaging, but that requirement doesn’t apply to those who buy the product. A Fox 13 report indicated police may have thought otherwise.

Tommie Burnette Sr., who was charged with misdemeanor possession, says he will appeal.
